4. Collection and Processing of Personal Data

Unless otherwise stated below, the provision of your personal data is neither legally nor contractually required, nor is it necessary for entering into a contract. You are not obligated to provide the data. Failure to provide it will have no consequences. This applies only insofar as no other information is provided in the following processing operations.

"Personal data" means any information relating to an identified or identifiable natural person.

When you use the contact form, I collect your personal data (name, email address, phone number, child's age, desired learning areas, desired learning duration, choice of price category based on household income, message text) only to the extent that you provide it. The data is processed for the purpose of contacting you. By submitting your message, you consent to the processing of the transmitted data. This processing is based on Article 6 Paragraph 1 Letter a of the GDPR with your consent.

You can revoke your consent at any time by notifying me, without affecting the lawfulness of the processing carried out based on your consent before its revocation. I use your email address only to process your request. Your data will then be deleted unless you have consented to further processing and use.

We collect and process personal data only if this is legally permitted or if you have given your consent.

This includes, in particular:

• Name, telephone number, email address

• Information from the contact form (e.g., age, desired learning areas, desired learning duration, choice of price category based on household income)

• Communication data (e.g., email correspondence)

• Billing data (e.g., for legal retention purposes)

5. Contact Form

If you contact us via the form on the website or by email, your data will be stored for six months for processing your request and in case of follow-up questions.

We will not share this data without your consent.

7. Legal Basis for Processing

Data processing is based on:

• Consent (Art. 6 para. 1 lit. a GDPR)

• Contract fulfillment / pre-contractual measures (Art. 6 para. 1 lit. b GDPR)

• Legal obligations (Art. 6 para. 1 lit. c GDPR)

• Legitimate interests (Art. 6 para. 1 lit. f GDPR)

8. Storage and Deletion

Personal data is stored only as long as necessary, as necessary to fulfill the respective purposes or as required by statutory retention periods. Afterwards, the data is deleted or anonymized.

11. Data Sharing with Third Parties

We only share personal data if legally permitted, if you have given your consent, or if it is necessary for the performance of a contract (e.g., with a tax advisor for accounting purposes).

Data is not shared with third parties for advertising purposes.

12. Your Rights

You have the right to access, rectify, erase, restrict processing of, and transfer your personal data stored by us, as well as the right to withdraw your consent and object to processing. If you believe that the processing of your data violates data protection law or that your data protection rights have otherwise been infringed, you can contact info@lernpraxis-fidelio.at.

In accordance with Article 15 of the GDPR, the data subject has the right to request confirmation from the controller – upon proof of identity – as to whether personal data concerning him or her are being processed. If this is the case, the data subject also has the right to access this personal data and the information specified in Article 15(1) of the GDPR, such as the categories of personal data and other information.

The data subject has the right to request from the controller the immediate rectification of inaccurate personal data concerning him or her (right to rectification pursuant to Article 16 of the GDPR).

Under the conditions of Article 17 GDPR, the data subject has the right to erasure (“right to be forgotten”) of their personal data, for example, if:

  • the data are no longer necessary for the purposes for which they were collected or otherwise processed;

  • the data are being processed unlawfully; or

  • in the case of processing based on consent, the data subject withdraws their consent.

  • if the company has made the personal data that must be erased public, it has the following obligation under Article 21(2) GDPR: Taking into account available technology and the costs involved, reasonable steps must be taken to inform other controllers processing the personal data that the data subject has requested the erasure of all links to, copies of, and replications of that personal data.

If the company has made the personal data public, it has the following obligation under Article 21(2) GDPR: Taking into account available technology and the costs involved, it must take reasonable steps to inform other controllers processing the personal data that the data subject has requested the erasure of all links to, copies of, and replications of that personal data. The right to erasure does not apply, however,

  • if there is no ground for erasure (i.e., none of the aforementioned grounds apply) or

  • if the exceptions listed in Article 17(3) GDPR apply, for example, if processing is necessary for compliance with a legal obligation under EU or Austrian law (e.g., statutory retention requirements) or for the establishment, exercise, or defense of legal claims.

The data subject has the right to restriction of processing pursuant to Article 18 GDPR, for example,

  • if the data subject contests the accuracy of the processed data,

  • the processing is unlawful, or

  • there is a dispute between the company and the data subject as to whether a right to erasure exists. In this case, the company will only store the data in question but will not process it in any other way.

If the data subject requests erasure or restriction of processing, or objects to processing (see the end of this Privacy Policy), they will be informed immediately about the measures taken or the reasons why the company is unable to implement them. According to Article 20 of the GDPR, the data subject has the right to receive the personal data concerning them, which they have provided to the company, in a structured, commonly used, and machine-readable format. This applies only if the processing is carried out by automated means. Furthermore, they have the right to transmit this data to another controller. The controller to whom the personal data has been provided must not hinder this (right to data portability). Where technically feasible, they have the right to have the personal data transmitted directly from one controller to another.

13. Data Security

Wix protects your data against loss, misuse, and unauthorized access through SSL encryption and other technical measures.

We do not store any sensitive data locally without appropriate security measures.

14. Changes to this Privacy Policy

We reserve the right to amend this privacy policy as needed to adapt it to new legal or technical developments.
